GALACTUS the Chipmunk™ is a furry bundle of radiation, a prisoner of the universe’s gravitational fields, forced to melt through one side of a planet and out the other over and over until it finally breaks apart in an explosion sending GALACTUS the Chipmunk™, an endless Spirograph™ of destruction, onto the next victim.

On one planet, GALACTUS the Chipmunk™ heard the sounds of a particularly jazzy rendition of “Suicide is Painless (Theme from ‘M.A.S.H’)” wafting out the window of a Universal Trademark Office. On subsequent flybys, GALACTUS the Chipmunk™ enlisted a third party designee to fill out and authorize the necessary forms to trademark “GALACTUS the Chipmunk” and the request was processed and uploaded to the central office before the planet was torn apart. So he’s got THAT going for him…

All of this is happening in an alternate universe to our own. So we should be fine and all relevant trademarks should be uninfringed.
